Being A Writer Membership Terms & Conditions

Welcome to the Being A Writer Community. By becoming a member you are agreeing to comply with and be bound by the following terms and conditions, which together with our Being A Writer Community Guidelines, Website Usage Terms and Conditions and Privacy Policy govern The Literary Consultancy’s relationship with you in relation to the Being A Writer Community and any membership thereof.

The term ‘The Literary Consultancy’, ‘TLC’or ‘us’ or ‘we’ refers to the owner of the website and ‘Being A Writer Community’ whose registered office is East Side, Kings Cross, London N1C 4AX. Our company registration number is 457 5807 and our VAT number is 749 6984 55. The term ‘you’ or ‘member’ refers to the Being A Writer member.

Use of Membership

Being A Writer Membership is personal and the membership and benefits cannot be used by anyone apart from the individual members.

Data Protection

The Literary Consultancy will implement and maintain reasonable procedures for protecting personal information in compliance with applicable law and our Privacy Policy.

Opting out of Renewal

You may opt out of renewing your membership via your online account (please go to Account, then Subscriptions in your membership dashboard) or by contacting us.

Cancellations and Refunds

If you sign up for a free trial, you may cancel at any time during the free trial period and incur no charge. Access to your member’s account will cease immediately. Monthly subscriptions and any subscription that is billed on a monthly basis may be cancelled at any time but are not eligible for a refund. For annual subscriptions you may cancel within seven days of the renewal date and receive a full refund. If you cancel your subscription but are not eligible for a refund, you will retain access to your member’s account until your subscription expires. Cancellations may be made via your online account or by contacting us. All refunds will be given to the original credit or debit card on which the purchase was made. Please allow a reasonable time for the refund to reach you or be charged back to your account.

Prices

From time to time we may need to increase the price of membership. We will give you at least one full month’s notice of any incoming price increase and will make it clear when the price increase will take effect and how much your membership will cost after the increase. During this period you will have your usual right to terminate your membership in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice then the price of your membership will be increased in accordance with the notice.

Eligibility, suspension or termination

The Literary Consultancy or the Member may terminate the membership and agreement evidenced by these Terms and Conditions with or without cause at any time by providing written notice to the non-terminating party.

We can suspend or terminate your membership at any time and for any reason (acting reasonably of course), including for the following reasons:

  • failure to pay the agreed membership fee
  • failure to comply with the Being A Writer Community Guidelines
  • failure to comply with these terms and conditions
  • if you have made statements to us which are incorrect or have failed to disclose facts of circumstances required to be disclosed under these terms and conditions

If we do decide to permanently terminate your membership and account you must not apply for a new account as unfortunately you will no longer be welcome in the Being A Writer Community.

The Literary Consultancy may change these membership terms and conditions at any time, without giving notice to the individual member. Such changes will, unless otherwise stated, take immediate effect. The Literary Consultancy will publish changes to these terms and conditions on its website. However, members are responsible for keeping themselves updated in relation to any changes to the terms and conditions.

Liability Disclaimer

We make no express warranties or representations as to the quality and/or accuracy of the content, the website or the service and we expressly disclaim any implied warranties, conditions and/or representations. We offer the content, website and service on an “as is” basis and do not accept responsibility for any use of or reliance on the website, content or service, or for any disruptions to or delay in the service.

To the fullest extent permissible under applicable law, we limit our liability. In particular, we shall not be liable for any damages that we cause unintentionally and we shall not be liable to you for any actual, incidental, indirect or consequential loss or damage howsoever caused.

Should the Being A Writer Community or Membership service have to be discontinued due to conditions pertaining to a country’s legislation, a court decision or a prohibition by a country’s public authorities, The Literary Consultancy will not be responsible for any losses to individual members which may ensue from this. The Literary Consultancy will, as far as possible, attempt to inform the individual member quickly if circumstances described under this point, should arise.
